Privacy Policy

Your privacy is important to Momentum Sports Algorithms LLC (d/b/a "Momentum Bets") ("Momentum Bets," "we," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, and protect information through our website and services (collectively, the "Service").

By accessing or using the Service, registering for an account, subscribing, or otherwise interacting with us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Service.

Geographic availability: The Service is offered in the United States and may be offered in Canada only to users physically located in Ontario, as described in our Terms and the Canada Addendum (Ontario Only).

1) Information We Collect

We collect information you provide, information collected automatically, and information from third parties.

A. Information You Provide Directly

Account Registration & Profile

  • Name (if provided)
  • Email address
  • Sign-in information. We use passwordless sign-in (emailed sign-in links) and third-party sign-in (e.g., Google); we do not collect or store account passwords

Phone Number & Messaging Preferences

  • Mobile phone number (if you provide it)
  • SMS preferences (Service/Transactional alerts opt-in/out; Marketing/Promotional opt-in/out)
  • Consent logs (e.g., opt-in timestamps, opt-out events)

Subscription & Billing

  • Subscription plan and billing cadence (monthly/annual)
  • Billing address (if required)
  • Payment status and transaction history

Note: Payments are processed by third-party payment processors. We generally do not store your full credit card number; we may receive limited information (such as card brand and last four digits) and payment confirmation details from our processor.

Criteria, Preferences & Settings

  • The criteria you configure and related preferences used to generate alerts and notifications.

AI Assistant & Chat Content

  • Prompts, messages, and other content you submit to AI-powered features (for example, the AI assistant or plain-English alert drafting), the responses generated, and any feedback you provide on them.

Please do not include sensitive personal information (such as government identifiers, financial account numbers, or health information) in AI chats or prompts. See Section 6 (AI Features) for how this content is processed.

Communications

  • Information you provide when contacting support, sending emails, or otherwise communicating with us (including message content and attachments you choose to provide).

B. Information We Collect Automatically

When you access the Service, we may automatically collect:

Device and Usage Data

  • IP address
  • Browser type, device type, operating system
  • Referring/exit pages, pages viewed, clicks and feature usage
  • Dates/times of visits and interactions

Approximate Location Data

  • General location (e.g., city/state/province) inferred from IP address or similar signals.

Cookies and Similar Technologies

We use cookies, pixels, SDKs, local storage, and similar technologies to operate and improve the Service. See Section 4.

Push Notification Data (if you enable push notifications)

  • Push subscription identifiers for your browser or device (such as a subscription endpoint or device push token and related delivery keys)
  • Notification delivery and confirmation status, used to deliver alerts and manage fallback delivery

SMS Delivery and Carrier Metadata (if you use SMS)

  • Delivery status (delivered/failed), carrier response codes, and other metadata necessary to deliver messages and manage consent.

C. Information We Receive from Third Parties

We may receive information from:

  • Authentication providers (for example, if you sign in with Google, we receive your name, email address, and profile photo from Google)
  • Payment processors (payment confirmation, subscription status, dispute/chargeback notices)
  • SMS providers (delivery status, opt-out events, carrier information)
  • Analytics/security providers (aggregated performance metrics, security/fraud signals)

2) How We Use Your Information

We use information to:

Provide and Operate the Service

  • Create and manage accounts
  • Provide criteria-based notifications and related features
  • Provide customer support and respond to requests

Billing and Subscription Management

  • Process subscription payments, renewals, and billing notices
  • Prevent fraud and address billing disputes

Communications

  • Deliver criteria alerts and other notifications through the channels you enable (such as push notifications and/or SMS)
  • Send Service/Transactional Messages (criteria alerts, account/security, billing/subscription notices, service updates) if you opt in
  • Send Marketing/Promotional Messages only if you separately opt in
  • Send emails for service administration and, where applicable, marketing emails (you can unsubscribe from marketing emails)

AI Features

  • Generate responses to your prompts and draft alert criteria from your descriptions
  • Maintain your conversation history within your account
  • Review AI interactions and feedback to improve quality and safety, and to enforce usage limits

Improve and Maintain the Service

  • Analyze usage patterns, troubleshoot, and improve performance and features

Safety, Security, and Legal Compliance

  • Protect users and the Service, prevent abuse and unauthorized access
  • Enforce our Terms
  • Comply with legal obligations and respond to lawful requests

Eligibility and Location Verification

  • Verify supported regions and enforce Canada availability limited to Ontario (as described in the Terms)
  • Verify SMS eligibility (e.g., +1 NANP numbers)

3) How We Share Information

We do not sell or rent your personal information.

We may share information as follows:

A. Service Providers

We share information with vendors that help us operate the Service (e.g., hosting, payment processing, notification delivery (push, email, and SMS), analytics, error monitoring and diagnostics, AI model providers that process your AI prompts on our behalf to generate responses, customer support, and security). These providers may access information only as needed to perform services for us and are expected to protect it.

B. Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction, subject to standard confidentiality protections.

C. Legal, Safety, and Enforcement

We may disclose information if we believe disclosure is necessary to comply with law, respond to valid legal process, enforce our Terms, or protect the rights, property, and safety of Momentum Bets, our users, or others.

D. Aggregated or De-Identified Data

We may share aggregated or de-identified information that does not reasonably identify you for analytics, research, and service improvement purposes.

4) Cookies, Tracking Technologies, and Web Beacons

A. Cookies and Similar Technologies

Cookies are small files placed on your device when you visit a website. We use cookies and similar technologies to operate and improve the Service.

We may use:

  • Essential cookies (necessary for core functions and security)
  • Analytics cookies (help measure performance and usage)
  • Marketing cookies (used to measure marketing effectiveness; if we use targeted advertising cookies in the future, we will update this policy and provide required choices)

Third-party cookies: We may use third-party tools for analytics and performance. If we introduce third-party advertising cookies for targeted advertising in the future, we will update this policy and provide clear notice and choices consistent with applicable law.

B. Session Replay

With your consent through our cookie banner, our analytics tool may record how you interact with pages on the Service (a "session replay"), with text you type masked, to help us understand usability and improve the Service. Separately, our error-monitoring tool may capture a limited, masked replay of a session when an error occurs so we can diagnose and fix problems; text is masked and media is blocked in these diagnostic replays.

C. Cookie Banner

We present a cookie banner to obtain consent for non-essential technologies where required. Essential cookies and basic analytics operate as needed for the Service to function and to measure performance; analytics session replay starts only after you accept.

D. Web Beacons / Clear GIFs

We may use web beacons (also called pixels or clear GIFs) in emails or on the Service to understand whether messages were opened or links were clicked and to improve communications and user experience.

E. Managing Cookies

You can control cookies through your browser settings. Disabling cookies may affect functionality.

5) Notifications (Push, Email, SMS) and Consent Management

A. Push Notifications and Email

Criteria alerts are delivered primarily as push notifications. You control push notifications through your account settings and your browser or device settings. Separately, we send service-related emails (such as account, security, and billing notices) as needed to administer your account, and marketing emails only if you opt in; you can unsubscribe from marketing emails at any time using the link in the email.

B. Service/Transactional SMS

If you provide a mobile number and enable SMS notifications (or otherwise opt in), you consent to receive recurring automated Service/Transactional Messages. Message frequency varies. Message and data rates may apply.

C. Marketing/Promotional SMS (Separate Optional Opt-In)

Marketing/Promotional Messages are optional and are sent only if you separately opt in. Consent is not a condition of purchase or subscription.

D. SMS Opt-Out and Help

You can opt out at any time by replying STOP to any message. For help, reply HELP or email support@momentumbets.com. Unless you expressly indicate otherwise, replying STOP opts you out of all SMS/text messages to that number. We may send a one-time non-marketing confirmation message.

Opting out of SMS does not cancel your subscription. To cancel, email support@momentumbets.com as described in our Terms.

6) AI Features

We offer optional AI-powered features, such as an AI assistant and plain-English alert drafting. When you use them:

  • What we collect and store: your prompts and messages, the responses generated, related context (such as which feature you used), and any feedback you provide. Conversation history is stored as part of your account.
  • How it is processed: your prompts and the context needed to answer them are sent to third-party AI model providers, engaged through an AI routing service, that process this content on our behalf to generate responses.
  • Human review: authorized personnel may review AI conversations and feedback to improve quality and safety, investigate abuse, and enforce usage limits.
  • Not advice: AI features provide information about odds data only. They do not provide betting, financial, or other professional advice.

Please do not include sensitive personal information in AI prompts or chats. To request deletion of AI conversation history, contact us as described in Section 7.

7) Your Choices and Rights

A. Notifications and Marketing Communications

  • Push notifications: You can disable push notifications at any time in your account settings or through your browser or device settings.
  • Email marketing: You may unsubscribe using the link in the email (if provided) or by contacting us.
  • SMS marketing: You may opt out by replying STOP.

Even if you opt out of marketing, we may still send Service/Transactional messages and emails necessary for account administration (unless you opt out of SMS entirely).

B. Update, Access, or Delete Information

You may request to access, correct, or delete certain Personal Information by contacting us at support@momentumbets.com. We may need to verify your identity.

If you request deletion or close your account, we will take reasonable steps to delete information from active systems where applicable, but we may retain certain information as required or permitted by law (for example, billing records, dispute logs, security logs, and consent records).

C. Cookies

You can manage cookies through browser settings and any cookie controls we provide.

8) U.S. State Privacy Notices

A. California Privacy Rights (CCPA/CPRA-Style Disclosure)

If you are a California resident, you may have rights to request information about our collection and use of Personal Information, and to request deletion or correction, subject to legal exceptions.

Categories of Personal Information we may collect include:

  • Identifiers (e.g., name, email, account identifiers, IP address)
  • Commercial information (e.g., subscription and transaction history)
  • Internet or network activity (e.g., browsing/usage data)
  • Approximate geolocation data (IP-based)
  • Communications and AI chat content you choose to provide
  • Inferences drawn from usage to improve the Service (non-sensitive)

Categories we may disclose for business purposes include:

  • Identifiers
  • Commercial information (limited billing status/records)
  • Internet or network activity
  • Approximate geolocation (IP-based)

Sale/Sharing: We do not sell Personal Information. If we materially change our practices (for example, by enabling certain types of targeted advertising), we will update this policy and provide any required opt-out mechanisms.

To submit a request, email support@momentumbets.com. You may designate an authorized agent, subject to verification.

We will not discriminate against you for exercising privacy rights.

B. Nevada Privacy Rights

Nevada residents may request to opt out of the sale of certain covered information. We do not sell Personal Information. You may submit requests to support@momentumbets.com.

9) Do Not Track and Opt-Out Preference Signals

"Do Not Track" (DNT) is a browser setting. At this time, we do not respond to DNT signals. If that changes, we will update this Privacy Policy.

Some browsers offer opt-out preference signals such as Global Privacy Control (GPC). Because we do not sell or share Personal Information as those terms are defined by applicable law, these signals do not change how the Service operates today. If our practices change, we will update this Privacy Policy and honor applicable signals as required.

10) Data Retention

We retain Personal Information as long as reasonably necessary to provide the Service, meet legal obligations, resolve disputes, enforce agreements, and maintain security. Retention periods vary by data type.

11) Security

We use reasonable administrative, technical, and organizational measures to protect information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12) Children's Privacy

The Service is intended for individuals who are at least 18 years old. We do not knowingly collect Personal Information from individuals under 18. If you believe a minor has provided Personal Information, contact us and we will take reasonable steps to delete it.

13) International Data Transfers

If you access the Service from outside the United States, your information may be processed and stored in the United States or other locations where our providers operate. Data protection laws may differ from those in your jurisdiction.

14) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will update the "Last Updated" date and make the revised policy available on the Service. For material changes, we may provide additional notice (e.g., email or in-Service notice) where required or appropriate.

Your continued use after the effective date of an updated Privacy Policy constitutes acceptance of the updated policy.
